This End-User License Agreement (“Agreement”) governs your access to and use of The Flight Living reservation and payment application and related services (the “Application”), including its integration with Intuit QuickBooks Online and QuickBooks Payments. By connecting the Application to a QuickBooks company, or by using the Application to create, manage, or pay for a reservation, you agree to this Agreement. If you do not agree, do not use the Application.
Subject to this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Application solely for its intended purpose: creating and managing furnished-apartment reservations and processing the related payments. All rights not expressly granted are reserved by the Company.
You may not, and may not permit others to: (a) copy, modify, translate, or create derivative works of the Application; (b) reverse engineer, decompile, or disassemble any part of it, except to the extent this restriction is prohibited by law; (c) rent, lease, sell, sublicense, or otherwise transfer access; (d) circumvent or disable any security or access-control feature; (e) use the Application to violate any law or the rights of others; or (f) access the Application to build a competing product.
The Application connects to Intuit QuickBooks Online and QuickBooks Payments using OAuth 2.0. When an authorized user connects a QuickBooks company, the Company is granted access to accounting and payment functions only to: create and read customer records, record charges, deposits, holds, and refunds, store guest payment cards on file with Intuit, and record booking-related transactions. We request only the access needed for these functions and do not use QuickBooks data for any unrelated purpose. Your use of QuickBooks and QuickBooks Payments is also governed by your agreements with Intuit.
Card payments are processed by Intuit through QuickBooks Payments. Card data is tokenized and stored by Intuit; the Company does not store full payment-card numbers. By providing a payment card or authorizing a booking, you authorize the Company to charge that card for: reservation charges, security deposits and pre-authorization holds, incidentals or damages permitted by the reservation terms, and applicable taxes and fees, in each case as disclosed at the time of booking. Refunds are returned to the original payment method.
Some features require authorized sign-in. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old and able to form a binding contract to use the Application.
The Application, including its software, design, and content (excluding your data and Intuit’s services), is owned by the Company or its licensors and is protected by intellectual-property laws. “The Flight Living” and related marks are the property of the Company. QuickBooks and Intuit marks are the property of Intuit Inc.
THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED OR ERROR-FREE. INTUIT AND OTHER THIRD-PARTY SERVICES ARE PROVIDED BY THOSE PARTIES UNDER THEIR OWN TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE APPLICATION. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID TO THE COMPANY FOR THE RESERVATION GIVING RISE TO THE CLAIM.
You may disconnect the Application from QuickBooks at any time — from within QuickBooks (Apps → Disconnect) or from within the Application’s admin. Disconnecting revokes the Application’s access tokens and stops further access to your QuickBooks data. We may suspend or terminate access if you violate this Agreement. Sections that by their nature should survive termination (including Sections 7–9 and 11) will survive.
This Agreement is governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in San Diego County, California.
We may update this Agreement from time to time. Material changes will be posted at this URL with a new effective date. Your continued use after changes take effect constitutes acceptance.
